Terms & Conditions – valid from 01st January 2026

General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you” or “Customer”) with KUST. Sp. z o.o., hereinafter referred to as “KUST.” “us” or “we”, at the kust.com website, mobile website, or by telephone (jointly referred to as ”kust.com”).

Please make sure you have read and understood the Terms before placing your order. A prerequisite for using the Store and placing orders is reading and accepting these Terms & Conditions.

The inclusion of any products or services on kust.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

By registering in the Store and making purchases, customers provide their personal data and consent to its processing by KUST. in line with our Privacy Policy.

Customers may use the Store with or without registering. Registered users may create a Customer Account, where personal data and order history are collected. Customers may terminate their Customer Account at any time by contacting KUST.

Customers are liable for the accuracy of the personal data they provide. KUST reserves the right to refuse or cancel an order where provided data is false or raises justified doubts. Customers will be contacted in such cases to clarify the situation.

The customer is responsible for safeguarding their login and password. The Store is not responsible if the Customer shares their login details with third parties.

KUST. reserves the right to restrict access to the Store if a Customer violates these Terms.

Use of the Store is restricted to persons aged 18 or older (or the legal age of majority in your country).

Prices and delivery charges

All prices shown on kust.com include statutory VAT for EU countries. Import duties, fees, and taxes for non-EU countries are not included and are the responsibility of the Customer.

Shipping costs are shown at checkout. Free shipping may apply if the Customer’s order meets the free shipping threshold.

Ordering & conclusion of contract

Orders can only be placed via kust.com.

Once an order is placed, the Customer will receive an email confirmation. If an order cannot be fulfilled, KUST. will notify the Customer and, if payment has already been made, issue a refund.

Delivery

KUST. will deliver orders diligently, within a maximum of 30 days after payment.

Customers are responsible for accepting delivery. If a Customer refuses delivery or fails to pay required import taxes/duties, return shipping costs will be deducted from any refund.

Returns & Right of Revocation (EU Customers)

General Return Policy

  • Customers may return items within 14 days of receiving the order, in line with EU consumer law.

  • Customers must first request return authorization by emailing contact@kust.com before sending any products back. Unauthorized returns will not be accepted and will be returned at the Customer’s cost.

Hygiene Law – Exceptions

For hygiene and health protection reasons, certain products are non-returnable if opened:

  • Underwear

  • Swimwear

  • Socks

  • Skincare or cosmetic products

These can only be returned if the packaging remains sealed and unopened. If a Customer returns such products without authorization or in unsealed condition, KUST. will refuse the return and ship the products back at the Customer’s expense.

Condition of Returns

Returned items remain the responsibility of the Customer until received by KUST. Customers should always retain proof of postage.

Refunds are issued within 14 working days after KUST. receives and inspects the returned goods. Refunds will be made using the original payment method unless otherwise agreed.

Returns – Duo, Trio & Multi-Pack Products

Duo, Trio, and other multi-pack underwear products are sold as one bundled product under a single SKU and at a discounted bundle price.

In accordance with Article 16(e) of Directive 2011/83/EU (exceptions to the right of withdrawal for sealed goods which are not suitable for return due to health protection or hygiene reasons):

  • Underwear bundles are sealed for hygiene reasons.

  • If the seal or original packaging of any item within the bundle is opened or removed, the right of withdrawal for the entire bundle expires.

  • It is not possible to return individual items from a bundle.

  • Partial refunds are not offered. The bundle price applies only when all items are returned together, unopened, unused, and in their original condition.

To qualify for a return, all items in the bundle must be unopened, unused, and returned in their original packaging.

If a bundle is returned with one or more items opened, used, or missing, the return will be refused and the goods will be sent back to the customer.

Defective Products & Complaints

If a product is faulty or damaged, please contact us at contact@kust.com before returning it. Faulty products will be replaced or refunded, including shipping costs.

Products offered in the Store are brand new and original. Customers have statutory rights for 2 years from delivery for any lack of conformity with the contract.

Payment is authorized at order placement and charged when goods are dispatched.

Liability & Guarantee

Our maximum liability is limited to the value of your order.

KUST. complies with all statutory warranty and guarantee obligations.

Final Provisions

Polish law applies. Disputes may be submitted to the courts of Poland or, if required by law, to the courts of the Customer’s residence.

These Terms do not limit or exclude statutory consumer rights.

KUST. reserves the right to amend these Terms for legal, organizational, or business reasons. Customers will be notified of any significant changes.
